He married Mary Staughton Lynd, daughter of the Rev. Dr. Samuel and Leonora Maria Staughton Lynd, in April, 1846 in Washington, DC. They became the parents of Charles, Albert, Caroline, Eveline, and Gertrude.
Judge Burnet died in Cincinnati, OH on March 27, 1889 of bladder cancer.
