Nehawka Register, 2 May 1902 1:3--George Peters was released from the county jail last Thursday evening, having paid into the court the sum of $388 and furnished a satisfactory bond for the balance which is not yet due. We understand he has returned to his home near Avoca.

OBITUARY:
George Peters Dies In Weeping Water, George Emiel Peters, lifelong Cass county resident, died Friday, Nov 7 in Weeping water. Mr. Peters was born Aug 3, 1866 on a farm northeast of Avoca, one of eight children of Peter and Magdalena Peters, and died Nov 7 at the age of 86 years, 3 months and four days. On March 23, 1883, he was confirmed in St. John's Lutheran church. He spent his entire life in the community where he was born, farming until his health forced him to retirement. He then rented his land but remained in the farm home until two years ago when he moved to a rest home in Linclon. Three months ago he moved from there to the Hill Top Rest Home in Weeping Water, where he was residing at the time of his death. George was a member of Wyoming Lodge #29 of the Independent Order of Odd Fellows, for 32 years at Avoca. He was president of the Farmers State Bank in Avoca at the time of his death. He was preceded in death by his parents and all of his brothers and sisters. Left to mourn his passing is one daughter, Lena Burns, several nieces and nephews, also a host of friends. Funeral services were held at the Hobson Funeral Home in Weeping Water on Tuesday afternoon, Nov 11 at 2:00 pm. burial was at St. John's Cemetery, Nehawka. Rev. Fred C. Gardner, pastor of the Weeping Water Methodist church officiated at the service and S. H. Harmon sang "Abide With Me", and "Some Time We'll Understand:, accompanied by Mrs. Harmen. Pallbearers were Gus Neumeister, Gilbert Neumeister, John E. Baier, John W. Norris. Elmer Hallstrom and Laurence Wulf.

WILL:
Will of George Peter Emil Peters
I, George Peter Emil Peters, also known as George E. Peters, of Avoca, Cass County, Nebraska, being of sound mind, memory and understanding and knowing the uncertainty of this mortal life, do herby make, publish and declare this to be my last will and testament as follows:

First: I direct that all my just debts including expenses of last sickness and funeral expenses be paid.

Second: In case I have not otherwise provided for a Monument I direct that my hereinafter executor place a monument at my last resting place, to cost not to exceed #1000 to have engraved thereon my name and the date of my birth August 3, 1866 and the date of my death.

Third: All of the real estate of which I die seized I hereby give and devise unto Elmer Hallstrom of Avoca, Nebraska as trustee, to rent the same, collect the rents, pay the taxes, insurance and necessary repairs, and the sum of $250 per year for his services, and to pay two-thirds of the balance of the income therefrom annually to my daughter Lena Burns during her natural life; her share not to be subject to her debts, assignments or other claims against her. After her death my said land to be sold by my said trustee without any court action other than the admission of this will to probate, this will being his authority to sell and dispose of the same. Said trustee to divide the proceeds into eight equal shares and to be distributed as hereinafter provided in the next paragraph of this my said last will and testament.

Fourth: All the rest, residue and remainder of my property to be converted into cash by my hereinafter-appointed Executor, and by him divided into eight equal shares. The income of one share thereof to be held in trust by me said trustee hereinbefore appointed, to pay the income there from to my daughter Lena Burns during her life and at her death said one-eighth share, including the one-eighth share of the real estate, to go to her children share and share alike; the issue of any of her deceased children to take by right of representation.

One share including the one-eighth interest of the proceeds from my real estate to go to my brother William Peters, in case he is living, but should be predeceased me, then such share to go to his children, share and share alike; the issue of any deceased children to take by right of representation.

One share of said residue including the one-eighth interest from the proceeds from said real estate, to go to the children of my deceased sister Sophie Francen, share and share alike; the issue of any deceased child to take by right of representation.

One share of said residue included the one-eighth interest from the proceeds from said real estate, to go to my niece Rosa Peters, daughter of my deceased brother Herman Peters in case she survives me, but should she predecease me, such portion of my property to go to her children, share and share alike; the issue of any deceased child to take by right of representation.

One share of said residue including the one-eighth interest from the proceeds from said real estate, to go to the children of my deceased brother, Louis Peters, share and share alike; the issue of any deceased child to take by right of representation.

One share of said residue including the one-eighth interest from the proceeds from said real estate, to go to the children of my deceased sister Amelia Lence, share and share alike; the issue of any deceased child to take by right of representation.

One share of said residue including the one-eighth interest from the proceeds from said real estate, to go to the children of my deceased sister Emma Dunkak, share and share alike. The issue of any deceased child to take by right of representation.

One share of said residue including the one-eighth interest from the proceeds from said real estate, to go to my nephew William Kehlbeck, son of my deceased sister Elvina Kehlbeck, in case he survives me, but should he predecease me, such portion of my property to go to his children, share and share alike. The issue of any deceased child to take by right of representation.

It being my Will that the residue of my property herein disposed of including the one-third of the annual income from rents, over and above the taxes, insurance, repairs and trustee's fee, excepting the one-eighth share to my daughter Lena Burns, shall be distributed to my devisees and legatees on the settlement of my estate, but that the share of my daughter Lena Burns and the proceeds from the sale of the real estate shall not be distributed until the death of my daughter Lena Burns, at which time said share and the proceeds from the sale of my real estate shall be distributed according to this paragraph of my last Will and Testament.

Fifth: I here by nominate and appoint Elmer Hallstrom of Avoca, Nebraska to be executor of this my last will and testament said executor to be allowed such fees as executor as the law provides and is not covered by the provision herein before provided for his services as trustee.

Sixth: I hereby revoke any former wills by me made.

In witness whereof I have hereto subscribed my name and declared this to be my last will and testament this 2nd day of June 1944, in the presence of Estella L. Rutherford and W. A. Robertson, each of whom I have requested to witness my signature hereto and hearken unto my declaration hereof.
