Last Will And Testament Of Peter Andrews, Written 9 Dec 1839
In the name of God Amen, I Peter Andrews of the township of Lampeter in the County of Lancaster and state of Pennsylvania, do consider the uncertainty of this life and that it is ordained for all men to die. I therefore make my last will and testament in manner following to wit, FIRST- and principally I commend my soul to God and my body to the earth in humble hope of a glorious resurrection and a happy admission into the regions of immortal life and glory through the merits of our redeemer Jesus Christ and as to my worldly estate I give and bequeath the same in manner following to wit, I will that all my just debts and funeral expenses shall be paid out of my estate as soon as conveniently may be done after my decease. ITEM- I give and bequeath unto my beloved wife Mary the benefit and use of all my mansion places with all the appurtenances containing sixteen acres of land, be the same more or less during her life or widowhood for her maintenance and the education and maintenance of all my children during their minorities and as to my personal estate I order and direct that such articles and things as my executors may deem useful to my said wife Mary, shall be sold at private or public sale to wit, wagons, plows, harrows, hay, ladders together with all other household and farming untensils which she may not want for her use, except my carpenter tools which I order to be put in a chest and saved for my two sons Jacob and Benjamin and to be equally divided among them when my son Benjamin attains the age of twenty-one years. ITEM-my money at interest and the money arising from the sale of my said personal property shall be kept at interest from time to time, at secure places and the interest accuring thereon shall also be put on interest except so much thereof as my said wife Mary shall want for her and my children's use, and further it is my will and meaning that my said wife Mary shall continue
housekeeping and maintain all my children during their respective minorities and have them sufficiently educated and in case my two sons Jacob and Benjamin either of them shall choose to have some mechanical art or trade, then my said wife Mary or her coexecutor shall indeavor to find a good master for him or them who shall care as well for the welfare of the boys soul and body as for the acquisition of the art he instructs- and I appoint my said wife Mary and her coexecutor, guardians over all my children to wit; Maria, Jacob, Magdalena, Lydia and Benjamin who shall use their utmost endeavor to promote the welfare of my children, both to soul and body and bring them up in the fear of the Lord teaching them piety and religion, and in case my said wife Mary shall at any time hereafter marry again then and in that case all her rights and privileges given and granted to her by this my will and testament shall cease and no more and she shall settle off with coexecutor giving up all things which she holds by virtue of this will unto her coexecutor or his survivor for the benefit of all my children who shall do therewith according to justice and law and in case my said wife, Mary should depart this life or marry again before my son Benjamin attains the age of twenty-one years, then I order that all my household kitchen furniture and farming utensils be sold at public sale and the money arising therefrom shall be put on interest in the same manner as my other money is at interest until my son Benjamin attains the age of twenty-one, and my realestate shall be let out for rent until my son Benjamin attains the age of twenty-one at which time I order and direct that my realestate shall be valued and appraised by as many disinterested men as there shall be at that time of my children living, that is to say I will that each of my children shall choose one disinterested acre and there so chosen they shall value my realestate whereon I now live, then I give and bequeath the said realestate containing sixteen acres of land more or less to my son Jacob Andrews with all the appurtenances thereto, belonging at and for the sum or valueation made by the said so chosen men to have and to hold the same to him my said son Jacob Andrews and to his heirs and assigns forever and in case my said son Jacob shall decline accepting my said realestate at the valuation aforesaid there and in that case I give and bequeath my said mansion place or realestate with all the appurtenances unto my said son Benjamin Andrews at the valuation aforesaid to have and to hold the said sixteen acres of land with the appurtenances unto my said son Benjamin Andrews and his heirs and assigns forever and in case my said son Benjamin shall also decline accepting the said premises at the said valuation then I order that it shall be sold by my executor or his survivor at public sale to the highest and best bidder and the money arrising thereon together with all my other money and estate of what kind and nature soever shall be parted and divided equally to and among all my children or their legal representatives share and share alike.
