Jim Kirk moved with his mother Ophelia and Step-father Henry Fox to Trinity County, Texas after 1911 with brother Will and other Fox siblings. The family farmed in the settlement of Nathan north of Groveton. He served in Army in Europe in WWI where he was exposed to mustard gas. Apparently his health was never good after that. He fought in the TX 33rd Infantry in Major operations: Le Hamel (four companies), Meuse-Argonne Offensive, Somme offensive, and St. Mihie.

His wife, Avary Belle died young leaving him with three small sons: Elbert (called Junior), Billie & William Lee. Like the rest of his siblings Jim was a musician & played the guitar.
