Day met a woman named Eva Atkins. Two days before they were to get married, Eva eloped with Neil Hubbs, Day's best friend. When the newlyweds returned to Chico, Day argued with Neil, the two drew pistols and fired at each other. Day mortally wounded Hubbs, shot Eva and clipped her ear, went to an upstairs room and shot himself. Both men died on July 27.
