He married Martha Jane Newman Carter on Sept. 15, 1865 in Marshall Co., TN. She was the daughter of Robert D. Carter.

Josiah joined the Confederate Army, 3rd Regiment, TN Infantry (Clack's) Co. H as a private on May 16, 1861. Trained at Camp Cheatham and were forced to surrender after the Battle of Fort Donelson, TN and held at Union Camp Doughas Prison near Chicago, Illinois. In September 1862 they were returned ot Vicksburg, MS and exchanged. The regiment reorganized and went back to war, fighting in the Battles of Chicasaw Bayou, MS.
