Mary Eliza Tilley and her 2 siblings, Georgiana A. Tilley and Francis W. "Frank" Tilley became orphans at the ages of 9, 7, and 2 respectively when their father George W. Tilley died on his way home from a trip to Galveston on December 14, 1857. His wife Frances Tilley either had already died or they died in the same accident. The Wharton County Court on December 16 ordered George's brother Stephen Tilley to take responsibility for the estate and the children, including specifically the "money deposited by the said decedant with Blum & Mayblum [a mercantile establishment in Richmond, Texas]...and to take charge of all other purchases made by the said decedant while in Galveston and Richmond during his recent trip." On January 25, 1858, James O. Myers was appointed administator of the estate, and on February 22, 1858 he was appointed guardian of the children, reporting "that the said Myers is their relative by affinity and that he is a proper person and that his appointment has been requested by the nearest relative of the children." James O. Myers was married to Frances' sister Ann George. However, the children were living with their grandmother Nancy George at the time of the 1860 census. The estate was settled by order of the Court in May 1870, with a division of the property to the three children.
