Toliver enlisted in the Confederate States Army on 15 September 1864 in Columbia, South Carolina. He was captured 24 March 1865 at Aveoysboro, North Carolina. As a prisoner of war he was sent from New Bern, North Carolina to Hart's Island, New York Harbor arriving on 10 April 1865. He was released on 16 June 1865 after taking the Oath of Allegiance.
