In 1868, McGinnis, who was accompanied by his 16 year old son, had an encounter on the streets of Knights Ferry. Mr. Cheshire, a teacher of one of McGinnis's children, made some comments that resulted in a confrontation between Cheshire and the elder McGinnis. Pistols were produced, shots fired and Cheshire was left standing. McGinnis's 16 year old son picked up his dead father's pistol and killed Cheshire. McGinnis was tried and acquitted. McGinnis was survived by a wife and children.
