Will of Capt. Charles Thornton:
In the name of God Amen; I Charles Thornton of the county of Jefferson and the state of Kentucky being weak and in a low state of health, but of sound mind do declare this to be my last will and Testament, and do hereby revoke all former wills and Testaments heretofore made by me. In the first place I do direct my Executors after my decease that they shall dispose of all my landed estates except my seven lots in the Town of Westport in the state aforesaid either at public or private sale for cash or on a credit as to them may appear best, and I do direct that the rent proceeds of said sale be equally divided amongst my four youngest sons to wit Daniel McCarty Fitzhugh Thornton, George Henry Fitzhugh Thornton, Francis Fitzhugh Thornton and William Tucker Thornton. Item. After my just debts shall have been paid, I do then direct that the residue of all my property of every description whatsoever excepting the seven lots above mentioned, be appropriated as follows; I do will and direct that the sum of eight pounds in specie be paid unto each of my five youngest sons to wit John Henry Fitzhugh Thornton, Daniel McCarty Fitzhugh Thornton, George Henry Fitzhugh Thornton, Francis Fitzhugh Thornton and William Tucker Thornton, and when the balance of said property shall be divided amongst the heirs of my son Charles Thornton, not only those that he now has, but also those that he may hereafter have, and my five youngest sons, and my five youngest sons above named after the legacies hereafter to be mentioned shall have been paid. and I do will and direct that that the property hereby willed to the heirs of my son Charles Thornton shall be kept together until the youngest shall have arrived at the age of twenty one years, and then be equally divided amongst them, and I do hereby appoint my son Charles Thornton to take possession of and mange said property for his use and benefit until it be divided as above directed and further I do especially bequeath unto Washington Berry Thornton the son of my son Charles Thornton my young sorrel mare colt aged two years last May; and do request his father to keep her for the use and benefit of his son. I do will and direct that the seven lots in the Town of Westport above mentioned be divided amongst the heirs of my son Charles Thornton my Grandson John Fitzhugh son of Cole Fitzhugh, and my five youngest sons heretofore named, and the division of said lots be made by each of the legates or their agent drawing lots for preference, without regard to the differences of valuation of the different lots, and I do appoint my son Charles Thornton agent for his heirs. Having heretofore given liberally to my sons Jones Fitzhugh Thornton, and Charles Thornton, and also to my Three daughters Henrietta Taliaferro, Catharine Presley Fitzhugh and Elizabeth Fitzhugh Merriwether (now deceased) I do direct my Executors to give to the four first mentioned the sum of Ten dollars, and I do also direct my Executors to give unto my Grandson, Richard Merriwether, the heir of my daughter Elizabeth Fitzhugh Merriwether the sum of Ten dollars which I bequeath unto him as a memento of my affection for himself and his mother. I bequeath unto my son Francis Fitzhugh Thornton my riding mare, saddle and bridle or should I dispose of her before my decease, whatever riding horse I may have at that time. and whereas my son Charles Thornton is indebted to me the sum of one hundred dollars. I do hereby release him from the obligation of payment of said debt. Lastly I do appoint my three eldest sons Jones Fitzhugh Thornton, Charles Thornton, and John Henry Fitzhugh Thornton executors to this my last will and Testament. As witness my hand, seal this twenty ninth day of January in the year of our Lord on thousand, eight hundred and twenty three.

"I have been to visit the gravesite of Charles Fitzhugh in Oldham County, Kentucky and there was also a gravestone of his father Capt. Charles Thornton who left Caroline County, Virginia to homestead in Kentucky. The "graveyard" is tiny and consists of maybe five or six stones around a huge tree. It sits at the end of a county road (looks like you would be driving into someone's farm, but apparently it is a legitimate road. It is beautiful there. It sits high on a knoll and overlooks thousands of acres of rolling blue grass horse farms."
