The Legal notice was published in the State Indiana Sentinel (Indianapolis, Indiana) on Feb 21 and 28, 1850, and on Mar 7 and 14, 1850, stating her husband was not a resident of the state and that he should appear in Boone County Indiana Court the 3rd Monday in April 1850.
It is currently unknown if Allen deserted Martha or if he died or disappeared, as no record of Allen after the date of his marriage in 1838, and no information after the birth of his son, Peter, about 1839, has been found other than the legal notice regarding Martha's application for divorce.
