Shortly after his birth in 1839 his parents moved the family from Alabama to Randolph County, Arkansas. In 1845 the family moved to the Republic of Texas to settle on Peter's Colony land near the small town of Dallas. His mother, Theodosia Dobbs Bennett passed shortly after their arrival. His father, Hiram Bennett, with seven minor children staked his claim in the area of the East Fork of the Trinity River The town of Irving would later be formed on what was this land grant. The older children file claims in other parts of Dallas County with their families.

Josiah Leath Bennett served with the Texas Rangers as a young man, He married Louisa J. Moore, daughter of Albert Moore and Lucinda B. Cole , on 11 Nov 1860 in Dallas County, Texas. He served with the 6th Scyene 13th brigade Texas State Troops CSA and Co. C, 6th Texas Cavalry C.S.A. Family history records that he was at a picnic on the day the war was declared, and he went to join up. At one point he was at Lake Village, AR and fought there in the Battle of Ditch Bayou. His son, Manche, later moved to Lake Village in the 1920's, and lived on the property adjoining Ditch Bayou. After the War, Josiah migrated with a party of covered wagons from Texas, via the Oregon Trail, to Ellensburg, Washington
