According to family lore, Robert Oates died at about two years of age when he wandered into a field where trees were being cleared and burned. He fell into one of the fires and he died from the burns he sustained.
According to an Oates Family History written by Charles Spencer Oates, Robert was buried in the Stokes Graveyard in Henry County.

At his death, James Robert Oates was survived by his parents, Robert and Sarah Matthews Oates; his siblings, Stephen M. Oates, Mary J. Oates, Elizabeth L. Oates, Charles S. Oates, Ephraim E. Oates, Susan Jane Oates, and Margaret M. Oates; his paternal grandmother, Elizabeth Shipp Oates; and his maternal grandparents, Moses Matthews and Mary Ann "Polly" Truitt Matthews.
This child was preceded in death by his paternal grandfather, Stephen Oates.

On October 31, 2022, a memorial marker was purchased for James Robert Oates. When completed, this marker will be placed in the Oates Family plot in the Rice Cemetery in Ollie, Polk County, Texas. The marker will be placed next to the tombstone of James Robert Oates' father, Robert Oates.
On June 10, 2023, the memorial marker for James Robert Oates was placed in the Oates Family plot in the Rice Cemetery.
