He was the only child of Stephen Deactur Petty & Nancy (Sibley) Petty. Served with the Confederacy in the Civil War. Family history alleges he contracted tuberculosis while a prisoner of war, which ultimately caused his early death.

Death notice - from "The Gadsden Times" Thursday, March 20, 1873:

SAD BEREAVEMENT -- The citizens of Gadsden and vicinity have to deplore the loss of an esteemed fellow townsman. Dr. J. S. Petty died on Saturday 15th, at 3½ P.M., after an illness of four weeks. The deceased had sown the seeds of consumption in his system shortly after the war, through excessive application to his professional studies, but with that hopeful infatuation which generally veils the insidious approaches of diseases of the lungs had no fear of dissolution; indeed was preparing for removal to Birmingham when he was seized with his last illness. He shared with his family the sad solace of spending his last moments in their midst.
