John Bate Smothers Jr who posted the bond that freed Kelly, his son-in-law, and Johnny W. Smothers, his son, on charges of shooting William Stubbs and James Tucker, as well as on other charges, was the patriarch of the clan: three sons, and six daughters, all of whom had married well so as to include the Turks, the Kellys, the Karneys, the McElroys, and so on. The patriarch, in turn, was one of 6 children born to John Bate Smeathers Sr by 2 wives who had come to DeWitt's Colony in Texas September 1828 from KY as a widower with 3: William mrd Cintha Kelly, Archibald Jacob [killed by Indians when young], and Mary Ann mrd Elijah Kelly, bro to Cintha.

The Hallettsville Tragedy
Pathetic Features of the Lamentable Affair Hallettsville, TX, August 6 - Our city has not yet recovered from the shock of yesterdays evening's tragedy. It was one of those sad, unfortunate occurrences that only the intervention of Divine Providence can prevent. These deplorable affrays will continue to occur until that disgraceful institution - the pistol law- is stricken from the statue. Under it the lawless element has at its mercy the law-abiding element. Our entire city is in mourning, and as these lines are being penned the church bells are tolling the funeral march of one who but a few hours ago was among us in all the vigor of youth and manhood. Amid the excitement yesterday evening, while the crowd was gathering around the bloody remains of Officer Stubbs, his young wife and three small children rushed upon the scene and what took place may be better imagined as described, "Sturdy men wiped the tears from their eyes and turned their faces from the agonizing scene with a sigh". But a few feet distant, his precious life-blood flowing over the pavement, lay James Tucker, surrounded by his weeping wife and children. Mr. Tucker is still alive, but can not live much longer. Four bullets took effect in the lower portion of his body, piercing his sexual organs and shattering one of his legs. Mr. Stubbs was shot through the head and death was so instantaneous that he was frozen to the shot and stood on hid feet fully two minutes before he fell. The shooting occurred at the Elstner Rock Saloon. Mr. Stubbs was constable of precinct No. 1 and was candidate for sheriff. Mr. Tucker is his brother-in-law. Bird Kelley and John Smothers, Jr. the slayers, are brother- in-laws.
Mr. Stubbs was expecting to be killed, the slayers having intimated they would kill him the first chance. The slayers came to town yesterday, and Stubbs knew it, and knowing they would attempt to kill him he told his brother-in-law, Mr. Tucker, to arm himself, which he did. Stubbs was walking by the saloon, when, it seems, that Kelly said:
I would like to see any g--d--d a--of a—arrest me." As he said this Stubbs walked toward him, as he did so a shot from within the building sent him to eternity. Shooting then began in earnest, and about twenty shots were fired. Tucker attempted to assist Stubbs, and the other two brothers-in-law held together. Several years ago Stubbs killed Bob Kelley, but was cleared on the plea of self-defense, as it is thought this old feud resulted in yesterday's tragedy. Smothers and Kelly are in jail. The grand jury is in session and will take the matter in hand. Both sides are well connected and feelings run high."

Paul Boethel is deceased. He didn't have any connections to the Kelly's or Smothers, but he was the District Judge at Hallettsville for Many years while Shannon "Pat" Kelly was District Clerk. Pat, who Died several years ago without ever opening his mouth about anything, was the grandson of Frank Kelly. I think he was Bird Kelly's son.
