John is my 2x paternal Gr-Grandfather. His parents have yet to be verified. He married:

1) Charity Walker on 3 Apr 1823 in Orange Co IN, the daughter of James & Betsey Walker of Greensboro, Guilford Co NC. Charity died c1833. Her Quaker burial record does not provide a date of death. According to newspaper articles, they had three children.

Newspaper articles reference "the three children of Charity Mosier". If the children's naming pattern of the time was adhered to, this questions the possibility that John's father was named Adam, since John's first son was not Adam Bowater Mosier (1840-1919), but Emeziah.

John migrated from NC to IN some time before 1823 when he married first wife Charity Walker. The biography of his son James, from "Counties of Morgan, Monroe & Brown IN" by Charles Blanchard, 1884, wrongly states John came to IN from NC in 1845. This is the year John and Charity moved to Morgan Co IN from Lawrence Co IN.


In the above referenced Bio, it also states John "died about twenty years after the move." Using the author's calculation this would be 1865. The following deductions below may help to better determine John's date of death:

a) Elaine, the last child of John of his second wife Hetty, was born Mar 1860. This means her conception would have been Jun 1859. We do know John was alive in Jun 1859.

b) The 6 Jun 1860 Census shows only Hetty and their children. Hetty is listed as a 'Farmer,' which appears to mean she is the head of household. Census records this year did not state marital status, but it can be assumed she is widowed.

c) Hetty married Joseph Lane on 25 Sep 1860, which concludes either John and Hetty divorced or John was deceased. Their separation by death or other means would be after Jun 1859, but before 6 Jun 1860, or at the latest before 25 Sep 1860.


Sadly, not much is known about my 2x Grandfather. Thanks to fellow researcher Sean, we now know more. John and first wife Charity inherited land in Guilford Co NC from the estate of her father James Walker.


On 13 Aug 1831, this land was parceled out to all of James Walkers' living children and/or the descendants of his deceased children, by order of the Guilford Co NC Court, Aug 1831 Term. John and Charity were present in Guilford Co NC at that time. The following transcription was made from an original recorded copy. Following this, there are newspaper articles regarding two petitions made by heirs who remained in North Carolina vs. those heirs who had left the state.

"In pursuance of the annexed tract we the undersigned Paul Coble, Roger Kirkman, John Hardin, John Hamner & Thomas McCullock, met on the Lands of James Walker Deceased, on the 12th day of August 1831 and made the following division & distribution of the Lands of James Walker deceas'd. Amongst the Heirs at Law of said James Walker deceas'd, Namely Betsey Walker, Susanna Field, Benjamin Walker, Lewis Walker John Moser & wife Charity, Simon Hadley & wife Alice, Robert Walker, Miley Jones, Franke Jones, Eli Garrett & wife Betsey & Belinda Jones, Containing Three Hundred & Seventy acres more or less Represented by the annexed plat A.B.C.D.E.F.G.H.I.

"No. 8 Begins at a Black oak at H. & runs South 128 poles to a Chesnite [chesnut] Stump at C.[or E.] then west 56 poles to a Stake at N[orth] then North 128 poles to a Spanish Oak at O.[?] then to the Beginning Containing forty five acres more or less Valued at Seventy five Cents per acre & laid off for Lewis Walker.


"- then to Equalize the Lots, Betsey Walker owner of No. 1 must pay to Lewis Walker owner of No. 8 the sum of two dollars, 14 3/4 cts, the Heirs of Rebecca Jones must pay Lewis Walker the Sum of Seven dollars 37 3/4 Cts. John Moser & wife must pay Susannah Field the sum of five dollars 64 Cts. The Heirs of Rebecca Jones must pay Susannah Field the sum of three dollars 39 3/4 Cents. Robert Walker owner of No. 4 must pay Susannah Field the sum of three dollars 27 1/4 Cts. Simon Hadley & wife must pay Susannah Field the sum of Nine dollars 39 3/4 cts. Benjamin Walker owner of Lot No. 7 must pay Susannah Field owner of No. 5 the sum of two dollars & 64 cts this payment being made within two years from this date.

Once the above land distributions were processed, John and Charity returned to Indiana, where Charity died about 1833. Charity's brother Robert and sister Alcey (Walker) Hadley, also left for Indiana. Siblings and children of deceased siblings, all who had remained in North Carolina, petitioned the courts for the shares of land belonging to those who had left the state, stating they had abandoned the land. The first petition is dated 19 Oct 1841:

"State of North Carolina, GUILFORD COUNTY.

Court of Pleas and Quarter Sessions, August Term, 1841.

Benjamin Walker, Lewis Walker, Miles Field, Edward Field, Emery Field, children of Susan Field, deceased, Riley Jones, Eli Garrett and Betsy his wife, Ruth Breedlove and Belinda, living children and heirs at law of Rebecca Jones, deceased.

vs.

Robert Walker, the three children of Charity Moser, deceased, Simeon Radley and Ailsey his wife. [sic Simon Hadley]

Petition for Partition of Land

In this case it appearing to the satisfaction of the Court that the defendants, Robert Walker and Simeon Radley [sic Simon Hadley] and wife, are not inhabitants of this State, -- It is therefore ordered by the Court, that advertisement be made for them for six weeks in the Greensboro Patriot, notifying them the said Robert Walker and Simeon Radley [sic Simon Hadley] and wife, to appear at our next Court of Pleas and Quarter Sessions to be held for the county of Guilford, at the courthouse in the town of Greensboro, on the 3rd Monday of November next, then and there to answer the petition of the petitioners, or an order of Court will be made to make partition of said Land.

Almost seven years later, the case was still ongoing as seen in the following article. Surprisingly this article mentions one of Charity's children by name: "Madison Moses" [sic - Moser]. It appears he may have been the oldest child of John and Charity, aged about 20 to 22 yrs in 1848, thus mentioning him by his full name in the petition:

"STATE OF NORTH CAROLINA, GUILDFORD County. In Equity, April Term, 1848.

Lewis Walker and others, }

vs.

Robert Walker and others.}

It appearing to the satisfaction of the Court, that Robert Walker, Simon Hadley and Alse his wife, and Madison Moses [sic] and others who are heirs of Charity Moses [sic], deceased, are not inhabitants of this State: -

It is ordered that publication be made for six weeks in the Greensboro Patriot, for them and each of them to be and appear before the said Court of Equity to be held for the County of Guilford, State aforesaid, at the court house in Greensboro, on the third Monday after the fourth Monday of March, 1848, then and there to plead, answer or demur to the petition; or the same will be heard ex parte as to them.
