Warmer Orders Alley Kept Open
San Bernardino’s downtown business section is greatly interested in a legal battle that was begun in superior court yesterday when Pattie Russell Bedford Holleran, Catherine Oehl and the San Bernardino Masonic Building association were granted a temporary injunction in superior court by Judge B. F. Warmer to permit them to use an alley at the rear of the properties.
The properties concerned include the northwest corner of Court and E streets, the middle of the block on E between Court and Fourth streets, and the middle of the block on Fourth street between E and F streets.
The action was directed against Thomas Lewis McFarlane, Florence E. McFarlane and the Cigar Stores Realty Holdings, Inc., represented by the San Bernardino law firm of Swing & Swing, Attorney Fred A. Wilson represents the plaintiffs.
According to the original complaint, the plaintiffs are attempting to prevent the defendants from closing an alley at the rear of their properties, which they allege has been in public use for more than 30 years.
In their answer and cross-complaint, Mr. and Mrs. McFarlane contended that the alley in question is not a public alley and that structures and barriers have been maintained for more than five years to enclose the properties.
The temporary injunction is expected to last until the suit is definitely settled, and is granted only on condition the plaintiffs post $1,000 bond.

Thomas Lewis McFarlane, native and life resident of San Bernardino, died Monday in a San Bernardino rest home. He was born 81 years ago, a member of an old pioneer family.
He had been a plumber and was a past president of the Native Sons of the Golden West, Arrowhead Parlor No. 110. He had also been active in civic affairs. He resided at 24536 Mill St.
Survivors include a son, Nevelle McFarlane, Riverside, and one sister, Mrs. Emma Beamer, San Bernardino.
Members of the Native Sons will officiate at services at 4 p.m. Friday at Lord’s Funeral Chapel. Cremation will be at Mt. View Cemetery. Interment will be in the family plot in Pioneer Cemetery.
