Handwritten will of Lilburn Warren Coffee

The State of Texas
County of Howard

Know all me by these presents, that I, L. Coffee of Howard County, Texas, being in feeble health at this time but of sound and disposing mind and memory do now make and publish this my last will and testament, revoking all other by me at any time made.

Item: - My three oldest children Lula Hardy, W.D. Coffee and Jerry Coffee have received from me heretofore the sum of Two thousand dollars each, or about that sum, and this sum by them respectively is estimated in making partition in this devise for my wife and my children, to whim I bequeath all my estate, real, personal and mixed and as hereinafter set forth.

Item: - I desire and will that none of my property be sold except as necessity arise, either to meet actual expenses or for better investment and that no partition or division be had that will deprive my wife Margaret Coffee of the means of adequate maintenance and support.

Item: - I desire that each of my children other than Lula, W.D. and Jerry to wit: Ruby, Maggie, Lilburn, Nellie, Lolis and Lillian Lee, shall receive first distribution each the sum of $2000.00, thus placing them on equality with my said three oldest children but any distribution to them shall be on reaching their respective majorities or till they are married, their interests to be held and preserved for them by my Executrix and Executors hereinafter named prior thereto, and after this said distribution then all my said children are to share the remainder of my estate equally, based upon value at time of such partition or distribution.

Item: - All the property of my estate is the community of my said wife and myself and I will that she have benefit not only of her 1/2 but such other parts of the whole so long and to such extent as her necessities require, and so long as she shall live, afterwards same to be equally divided and partitioned to my said children as above directed.

Item: - I nominate and appoint my beloved wife, Margarett Coffee Executrix and my sons W. D. and Jerry Coffee Executors of this will a majority of whom may act in any matter pursuant to their duties as such, and I direct that no bond be required of them or any of heirs as such and that no action be had by the Probate Court, of and concerning my said estate, save and except the filing and probating of this will and the returning and filing of all inventory of the property of my said estate.

Witness my hand, this 18th day of April A.D. 1906

/s/ L. Coffee

The above named testator, L. Coffee has here now signed in our presence the above instrument and we each at his instance in his presence and in the presence of each other hereto sign our names as witness thereto, we each being above the age of Twenty one years, this 18th day of April, A.D., 1906
