LAST WILL AND TESTAMENT OF JACOB WEAVER
Know all men by these present that I, Jacob Weaver of the County of Bates and the State of Missouri, being of lawful age, of sound and disposing mind and under no restraint, do make and publish this my last will and testament.

First, I give and bequeath to my beloved wife Martha A. Weaver all of my personal property of whatever kind except such as herein after is devised to my son George W. Weaver, subject however to the payment of my just debts.

Second, I give and bequeath to my son Geo. W. Weaver all my interest in the estate of my sister Katherine Norris, deceased, late of Brooklyn New York, and out of what he may realize of her Estate I desire him to pay a certain note owed one David McGaughy and such sum as I be indebted to J. N. Frizell.

Third, I give and bequeath to my son Geo. W. Weaver, all the cattle of which I may be possessed of whatever kind and the two horses known as Thom Nal, a sorrel horse and a spotted horse named George.

Fourth, having heretofore given to my several children namely: Felix R. Weaver, Jacob S. Weaver, Margaret Radcliff, Caroline Pennewell and Nancy Fisher such part of my property as would justly be theirs due, I hereby give each of them the sum of one dollar.

Fifth, I hereby appoint my dear wife Martha A. Weaver Executor of my will.

Pursuant to previous notice, the people of Deer Creek Township and vicinity met in mass meeting for the purpose of devising some means of procuring food for the destitute and needy.
...Whereas, It has in the providence of God fallen to our lot to be visited with famine and pestilence, until our section of country is reduced to destitution and want and the major part of the the people are compelled to suffer for bread unless assisted by those whom God has more highly favored; therefore,
Resolved, By the people of Deer Creek Township, Bates County, Mo, in mass meeting assembled, to to t he end and that suffering and death come not to the people for want of food and the country in these parts depopulated:
1st that there be a committee of three appointed to solicit aid for the destitute of this township and vicinity.
2nd That John Moudy, Jacob Weaver, Sr. and John Knisley be and are hereby appointed and constituted a soliciting committee for that purpose.
(Another committee was appointed to receive and distribute such aid as may be obtained to those in actual need. )

Jacob Weaver . . . [is] buried in Crescent Hill Cemetery, Adrian, Bates, MO. A Bates County historian has confirmed this. . . .The newspaper article also states Crescent Hill Cemetery at Adrian [Missouri].
