In June 1884, he graduated from Princeton University and was admitted to the bar in 1888. He practiced law in Chicago and in 1896 became a City Council Alderman. In 1897 and 1905, he ran unsuccessfully for mayor.
On October 15, 1890, he married Elizabeth Palmer Flagg at Yonkers, New York. They were the parents of four children:
Elizabeth Palmer Harlan Derby (1891–1990)
John Marshall Harlan II (1899–1971)
His son, John Marshall Harlan, II was a Supreme Court Justice from 1955 to 1971.
