James “Madi” Hinson, son of Charles Hinson (1732 – ca. 1790) & Nancy Gough (1763-1855) who m. 30 Dec 1806 in Fauquier, VA, was b. ca. 1785. James’ will was written Jan 1863 in Rappahannock, VA.

(Middle name may have been Madison after President James Madison (1751-1836 VA).

“He (James) lost his father while very young and was raised solely by his mother, in addition to being bonded out as a servant while still a juvenile. He apparently inherited nothing upon the death of his grandfather, Robert Hinson, in 1803. Possibly his marriage to Mary Dulin helped him get started.

James Hinson served in the 44th Regiment and 41st Regiment, Virginia, (Branhams and Paynes) during the War of 1812 during the period when the British sacked the Capitol and White House. He was stationed at Arlington, Virginia. He received two land warrants for this service, 40 acres and 80 acres.”

This may be a “missing son” who was the last child in the household with James & his mother, Nancy Gough Hinson (1850 Rappahannock, Virginia Census under “Hensen.”) On the Census his name was “James” b. 1829. By 1854 James/Shelton had migrated to MO with his family who had moved to MO with their mother, “Polly.” (Substantiated by self-report of birth in Fauquier, VA, a VA genealogist, DNA, and the 1850 Census. The name Shelton Hinson does not appear on any records until 1853 in Glasgow, Howard, MO. It is not known why he changed his name or a Census spelling error.

“At the time of the deaths of the close members of his family, he was a fairly affluent person. The executors sale on 24 March 1863 disposed of considerable personal property, including three slaves: Lewis, Martha, and Ann. The total proceeds from the sale were $12, 947 of which over $4,000 was for the three slaves. The man and one woman were purchased by Albert R. Singleton, his son-in-law.

"Disputes arose between his children who migrated before the Civil War to Missouri and those who stayed in Virginia.”

He signed a will on 21 January 1863 in Rappahannock County, Virginia

“Bill and Lenora Henson have seen field stones on the property just south of Hinson's MIll, which was apparently that sold by William C. Scott and Elizabeth Jane, which stones are the markers of a very old cemetery. However, it is believed that James Hinson would not have marked graves with field stones, but with marble. At the time of the deaths of the close members of his family, he was a fairly affluent person. There are many cemeteries in Rappahannock County today which have marble tombstones erected during the period before and after the Civil War. The most likely place for the Hinson cemetery would be the north side of the road on the first farm acquired, and which it appears is on or immediately east of the farm called, "Scotia".

His will was written 21 Jan 1863, but there are no further court documents until 9 March 1863, this being a List of his personal Property, valued at some $10,000. A list of his sold personal property was made on 24 Mar 1863 and was mostly bought by relatives and close friends. [Rappahannock Will Book D, pp 340-346, and garnered a total of $12,947.59. For some reason, neither the List of Property or the list of Sales was recorded until April 1865.

The reason for this lies in the evidence of Chancery Suit 527 (John S. Hughes vs. John G Hinson, executor of the will of James Hinson) and Chancery Book B, pp 236, 243-244, 249, 252-253, 259, 277-278, 303-304. These various transactions didn't seem to be finalized until 1875.
