Said defendants, and each of them, will take notice that they have been sued in the above entitled court by the above named plaintiff and must answer the petition filed by the plaintiff herein on or before the 30th day of June 1961, or the allegations contained in the petition will be taken as true, and a decree will be rendered in favor of the plaintiff, adjudging that the plaintiff, Effie Turbyfill, and Bill Dan Rowe are the owners of the full, legal and equitable title in and to the following described land in Beckham County, State of Oklahoma, to-wit:
Lots 28, 29, 30, 31, 32 and 33 all in Block 27 of the Whitehurst Addition to the Town of Sayre, Oklahoma, and a further decree adjudging and decreeing that the plaintiff's and the defendant's, Bill Dan Rowe, respective interest in and to the title in the above described property is prior and superior to any apparent or asserted right, title, interest or estate therein on the part of the defendants, oe either of them, and quieting plaintiff's and the the defendant's, Bill Dan Rowe title in the respective interest as set forth above as against any apparent or asserted right, title or claim on the part of the defendants, or any of them, and excluding the defendants therefrom; and a further decree determining that the old unreleased mortgage has been fully paid and satisfied and the statute of limitations has run thereon; and further adjudging and determining that the old unreleased mortgage has been fully paid and ratified and the statute of limitations has run thereon; and further adjudging and determining that the plaintiff, Effie Turbyfill, owns an undivided five-six-ths (5-6ths) interest in and to the above described property; and Bill Dan Rowe owns and(sic) undivided one-sixth (1-6th) interest in and to the above described property and this property should be partitioned and divided in kind; or this be impossible, the court appoint commissioners to separate and divide the property and - or appraise the property in order that the same might be sold as provided by law.
