"In the name of God Amen, I John T Ely of Lee County and State of Virginia being afflicted in body but of Sound mind and disposing memory do make and ordain this my last Will and Testament revoking all others. First of all I desire and direct that all my lawful debts be as speedily and puctually paid as circumstances will admit. And in the second place I hereby Will and bequeath unto my beloved wife Margaret, my whole estate real and personal and hereby make her my only legal heir and hereby desire and direct that she dispose of my whole estate real and personal without having the same valued as told. In Testimony to here of, I have hereunto Let my hand and Seal this the 13th day of February 1852. John (his mark) Ely {seal}

aforesaid at the courthouse thereof in the Town of Somerset. On the first
day of January 1861 - the foregoing instrument of writing purporting
to be the Last Will and Testament of John T Ely deceased was produced
to the court and proven by the oath of Orpah Ely and of the subscribing
witnesses thereto, to be the act and deed of the said John T Ely decd.
And the said Orpah Ely also testified to the signature of Abraham
Neff the other subscribing witness, and that the said John T Ely was of
sound mind at the time of signing the writing aforesaid, whereupon
said Will was ordered by the court to be recorded and the
same has been done accordingly. Given under my hand this 4th
day of January 1861 Att J D Allcorn Clk"

John T Ely first appears in the Lee County Tax list in 1813 as "John Ely", and on the same page lists his father "John Ely Sr". In the 1827 & 1828 tax lists, he is shown as "Jno's Son". In the 1834 tax list he is shown as "River John". The nick name "Tug" appears off and on in the tax list from years 1830-1844. The 1844 tax list shows his name as "John Tug Ely Sr". The nick name "Tug" may have come from an 1831 deed:
John Ely Sr to John Ely Jr, 75 acres for $250, 1831 Lee Co., Va
"...Beginning at three sugar trees & a small Beech on the Bank of Powels River at the upper end of the Tug Mountain Bottom and running
1. thence South 70 W 40 poles to a Stake
2. South 35 W 65 poles to a Stake
3. thence North 40 poles to the top of a Bluff Powels river
4. thence up the several courses of said river to the Beginning..."
