Agnes was the daughter of Anne Burton (1742-1810) and Robert Payne (1738-1791).
Her maternal grandparents were Capt Robert Burton (1718-aft1774) and his first wife, Christian.
Her paternal grandparents were Anna Fleming (ca1710-ca1780) and Josias Payne (1705-1785).
Her father was a brother of John Payne (1740-1792), thus, Agnes was a paternal first cousin of Dolley Payne Madison (1768-1849)
Agnes married 1st, on Feb 2, 1795, in Pittsylvania Co, Virginia, Robert Harris (1770-1797).
They had one son: Robert Simpson Harris, born about 1796 in Caswell Co, NC.
She married 2nd, on Dec 25, 1798, in Yancyville, Caswell Co, NC, Marmaduke Williams (1772-1850). They had 7 daughters and 2 sons, the first 3 born in NC, the last 5 after they moved to the Mississippi Territory (later Alabama) in 1810. They had settled in Tuscaloosa, Alabama, by 1821. Their 9 children were:

Eldest daughter, Keturah, and her husband, Josias (Joseph) Payne Saunders (1794-ca1835), had 2 children: Robert Payne Harris Saunders (ca1825-aft1850) and Agnes P Saunders Henderson. Keturah died in Wilson County, Tennessee, on Oct 27, 1827.
Daughter Matilda, and her husband, John W McCay (ca1805-aft1884), had six children: Dr William McCay, Agnes McCay Russell, Sarah Ann"Sallie" M McCay (1834-1914), Lt John Marmaduke "Duke" McCay (1840-1862), Martha McCay (ca1851-aft 1887), and Charles Lewis (Louis) "C. L." McCay (1858-aft1901).
J. M. "Duke" McCay was 2nd Lt, Company F, 41st Alabama Infantry Regiment, CSA. He died July 27, 1862 at Murphreesborough, Tennessee.
C. L. McCay lived mostly in Texas, where he married first, on Dec 19, 1878, Blanche Garrett, who died in 1882. He married second, on Nov 19, 1884, Hattie Lee Kone.
Judge Thomas Owen, son-in-law of Agnes and Marmaduke, had a house built in Tuscaloosa in the 1830s in which Agnes and Marmaduke resided during their retirement in the late 1840s. The house was still standing in the 1990s and restoration was undertaken by the Heritage Commission of Tuscaloosa in 1995. The house burned in 1996; restoration resumed in 2007, and was completed in 2009. The Marmaduke Williams house in now privately owned.
Agnes died in Tuscaloosa in 1850, two months before Marmaduke. Both were buried in Greenwood Cemetery, though no gravestones remain.
