Married Anne Burton on July 22, 1762 at St James Northam Parish, Goochland County, Virginia.
Anne was the daughter of Robert Burton and his first wife, Christian.
Anne was the granddaughter of Priscilla Farrar and Robert Burton of Goochland (1687-1748).
Anne Burton and Robert Payne were the parents of: Elizabeth Ann "Betsy" Payne Sanders, Martha Payne, Keturah Payne Dixon (first wife of Wynn Dixon), Anna Payne Harrison Shelton, Susannah Payne Ware , Robert Josias Payne, John B Payne, Agnes Payne Harris Williams, Charles Burton Payne, and Mary Woodson "Polly" Payne Harris Cooper.
Anne and Robert Payne and family moved from Goochland County to Pittsylvania County in about 1767. They called their new home "The Cascades" on the Southside of the Dan River. Neighbors included Robert's sister, Anna, and her husband, William Harrison, near Wenonda, near the North Carolina state line.
Robert Payne was a Pittsylvania County Justice of the Peace in 1769 and 1777.
Robert Payne was appointed Captain of one of 27 companies when Pittsylvania County formed a Militia in September, 1775, as the The Committee of Safety, for military defense, appointed its officers; the militia was commanded by Col Robert Williams.
Robert Payne was appointed to the Pittsylvania County Commission of Peace on Jan 23, 1777.
In April, 1885, Robert was granted a Deed of Gift by his father, Josias Payne, of the 800 acres of land on Licking Hole Creek in Goochland County, where the Plantation of Josias Payne was located. This land had already been bequeathed in the will of Josias Payne, which was written January 12, 1885, and was probated in Pittsylvania County on Dec 19, 1785.
Robert Payne made his will on Nov 15th, 1785; the will was probated on Dec 16th, 1791.
