To the County Court of Shenandoah County:

Respectfully complaining sheweth unto the Court your orators and oratrix Hiram Bauserman, Peter Bauserman, Abram Bauserman, Alexander Bauserman, Ellis Bauserman, Allen Bowman and his wife Elizabeth Catharine [Bauserman] Bowman, that Abraham Bauserman died intestate March 14th 1863, seized and possessed of a certain tract of land containing 160 acres more or less on the North Shenandoah River in the said County of Shenandoah adjoining the lands of Jacob Strickler, Abram Rosenberger, & others, leaving a widow Mary Bauserman who is entitled to dower in said lands, and the following children and only heirs, viz: your orators above named, and oratrix Elizabeth Catharine [Bauserman] Bowman who intermarried with the said Allen Bowman, John Bauserman, and Mary [Bauserman-Fravel] Keller late Mary Fravel formerly Mary Bauserman, she having intermarried with Moses Fravel. That said Moses Fravel died ___ 186___ leaving an only child by said Mary, viz: Margaret Ann Fravel who is still living and over 14 years of age. That said Mary Fravel formerly Mary Bauserman afterward intermarried with Wm. H. Keller and died Janr'y 1st 1864 leaving the following children to wit: The said Margaret Ann Fravel, Abram Keller and Ida Keller, all of whom are infants under the age of 21 years, and her husband Wm. H. Keller, still living, who is entitled to curtesy.

Your orators & oratrix further state that the land is unprofitable in its present condition, that no one of the parties is sufficiently able or willing to take charge, preserve, and farm the whole tract in a suitable and profitable manner, that therefore it is absolutely necessary that the said real estate be divided between the parties aforementioned entitled thereto according to law, viz:

The widow Mary Bauserman her dower, and the remainder into 8 equal parts, 1/8 to each of the seven living heirs and the remaining eighth to the children &c of the said Mary Keller dec'd. And in case the said real Estate be indivisible in kind, that a decree be rendered for the sale of the same upon such time and terms as the court may deem proper, and the proceeds thereof distributed among the parties entitled thereto.

Your orators and oratrix further state that there are debts against the estate over and above the value of the personal property, to the amount of Six or Seven hundred Dollars, and that John Bauserman qualified as the Administrator of the said Abram Bauserman's estate, and ask that he be required to settle his Administration accounts before one of the Commissioners of this Court, and that said Commissioner be required to ascertain what amount of debts are still due and remaining unpaid from the said estate and report to this court in order that the whole matter may be settled up, and in the event a sale is deemed necessary that the same may be satisfied before a distribution of the proceeds is had, and further ask that Commissioners be appointed to view said land and report to court whether such partition or sale out in their Judgment to be made, and if a sale be deemed necessary, whether the interest of any one of the heirs will exceed Three hundred dollars.

Your orators & oratrix further pray that the said Mary Bauserman (widow) & John Bauserman in his own right and as Administrator of the said Abram Bauserman dec'd, Wm. H. Keller, Margaret Ann Fravel, Abram Keller & Ida Keller, the 3 latter being infants, be made parties defendant to his bill; that a proper guardian ad litem be assigned the infant defendants to defend their interests in this suit; that they be required to answer the same on their oaths, the adults in proper person and the infants by guardian ad litem; that proper process may issue against said defendants; and that such other, further, and general relief may be afforded as the nature of the case may require or to equity shall seem meet and proper. And your orators and oratrix will every pray. &c.
