Last Will of
Theodore T. Curtiss
Know All Men By These Presents That, I, Theodore T. Curtiss, being of sound mind and memory, do hereby make, publish and declare this to be my last Will and Testament, hereby revoking any and all previous wills that have been made by me.

First.- I direct that my funeral expenses, the expense of my last illness and all my just debts be paid as soon as possible after my death.

Second.- I give, will, devise and bequeath to my daughter, Edith L. Curtiss, my home place at No. 3123 Edmond Street, St. Joseph, Missouri, including lots 35, 36, 37 and 38 and the west 15 feet of lot 59, all in Block 3 (3) in Sommers Grand Heights Addition to the City of St. Joseph, in Buchanan County, Missouri, and all the personal property belonging to me in said house, such as furniture and household articles and personal effects. I give this property to my daughter for her many services rendered to me and her mother and that she may render to me hereafter, and should I make a deed to said real estate to her it will be for the purpose of carrying out the terms of this will.

Third.- I give and bequest to my four children the following amounts:
To Edith L. Curtiss, Two thousand Dollars ($2000.00).
To Theodore P. Curtiss, Two Thousand Dollars ($2000.00).
To Elizabeth P. Kibler, Two Thousand Dollars ($2000.00).
To George R. Curtiss, Two Thousand Dollars ($2000.00).
Should any of my children predecease me, then in that event I give and bequest such sum to his or her child or children, and should any such child not have any bodily heirs, at my death, then such share shall go to my children then surviving.

Fourth. - I give and bequeath to my sister-in-law, Miss Agnes M. Paxton, Five Hundred Dollars ($500.00), and to my brother-in-law, P. D. Paxton, Five Hundred Dollars ($500.00); and if either of these two shall not survive me, then I give and bequeath both amounts to the survivor of them, but if neither of them shall be living at the time my estate is distributed, then both these bequests shall be void, and shall become a part of the residue of my estate.
Fifth.- I give and bequest to Mrs Henry W. Hughes, Five Hundred

Dollars ($500.00), but if she shall not be living at the time of my estate is distributed to the legatees, this bequest shall be void and shall become a part of the residue of my estate.

Sixth.- I give and bequeath to my daughters-in=law and my son-in-law each the following amounts:
To Catherine B. Curtiss, One Hundred Dollars ($100.00).
To H. H. Kibler, One Hundred Dollars ($100.00).
To Bernice C. Curtiss, One Hundred Dollars ($100.00).
Should anyone of said legatees die before the time of the distribution of my estate, then such sum shall become a part of the residue of my estate and such legacy lapse.
Seventh.- I give and bequeath to my grandchildren each the following amounts:
To Theodore B. Curtiss, One Hundred Dollars ($100.00).
To Robert H. Curtiss, One Hundred Dollars ($100.00).
To Charles Edward Curtiss, One Hundred Dollars ($100.00).
To Marcia Lou Curtiss, One Hundred Dollars ($100.00).
To David Kibler, One Hundred Dollars ($100.00).
And if any of my grand children herein named shall be a minor at the time of the distribution of my estate to the legatees, I direct my executor to pay the legacy of any such minor to its parents, or to such of its parents as shall be then living, as the natural guardian of such minor.

Eighth.- I give and bequeath to the Board of Home Missions of the Congregational Christian Church, the sum of Two Hundred Dollars ($200.00).

Ninth.- I give and bequeath to the American Board of Commissioners for foreign Missions, the sum of Two Hundred ($200.00) Dollars.

Tenth.- I give and bequeath to the Pilgrim Memorial Fund of the Congregational Christian Church the sum of One Hundred Dollars ($100.00).

Eleventh. I give and bequeath to the Pilgrim Memorial Christmas Fund of the Congregational Christian Church the sum of One Hundred Dollars ($100.00).

Twelfth. I give and bequeath to the American Bible Society, the sum of One Hundred Dollars ($100.00).

Thirteenth.- I give and bequeath to the Endowment Fund of the First Congregational Christian Church of St. Joseph, Missouri, the sum of Two Hundred Dollars ($200.00).

Fourteenth.- All the rest and residue of my estate, real, personal and mixed, and wherever situated and being, I give, will, devise and bequeath to my four children above named in Paragraph Three, share and share alike; and should any or one or more of my said children pre-decease me, then I give and will such share to the heirs of such child.

Fifteenth.- I hereby nominate my daughter, Edith L. Curtiss to be Executrix of this My Last Will and Testament and request that she be allowed to serve as such Executrix without bond; and I hereby empower and direct said Executrix to sell and convert into cast any of the notes, stocks or bond of any of my property in my estate for the purpose of making distribution thereof of any property and such sale may be made at public or private sale as she may think proper, and that she have such powers as may be necessary to conserve and protect all the interests of my said estate subject to the approval of the Probate Court Probating this will.

In Witness Thereof, I have hereunto set my hand this day of January, 1946, at St. Joseph, Missouri.

The foregoing instrument consisting of two pages including besides this one, was signed, published and declared by Theodore T. Curtiss, the testator named therein, to be his last Will and Testament in the presence of us and each of us, who, at his request and in his presence and in the presence of each of us so signing, have hereunto signed our names as witnesses on the day and date aforesaid.
