Will of John Miller Jr.
September 6th, 1848
In the name of God Amen I John Miller Jr. of the county of Pendleton and state of Virginia, weak in body, but perfectly sound in mind and memory calling to mind the mortality of all flesh, do make and ordain this my last will and testament, that is to say principally and firstly I recommence my soul into the hands of Almightly God and my Redeemer who gave it and my body I recommence to the earth from whence it was taken to be buried in a descent Christian like manner and at the descretion of my executor nothing doubting but in the ressurection at the last day shall receive it again-
And as touching these worldly goods where with it has pleased God to bless me in this life I bequeath and dispose of the same in the following manner and first of all my will is that all my funeral expenses and all other lawful debts be paid out of my moveable property.
Secondly my will is that my wife Margaret shall have and keep the remaining part of moveable property for her own use to bequeath or do with it what she pleases.
Thirdly my will is at my decease that my place formerly called the Walnut Bottom, shall be left for my widow for her own use for as long as she stays a widow in my name, but at her decease in said widowhood, or by marrying again she is off, and then the above mentioned place or lands shall fall to my grandchildren, namely Elizabeth Miller the wife of Elijah Stonestreet, and Amos Miller heirs of John T. Miller by paying eight hundred and fifty dollars in six annual payments four hundred dollars to John T. Miller, four hundred dollars to Susannah Sites and fifty dollars to Adam Miller--
And lastly I appoint my son John Miller as my executor in this my last will and testament, hereby remaining and revoking all other will and testaments by me made or done herefore declaring and confirming this to be my last will and testament-- In writing where of I have subscribed my name and seal this 6th day of September 1848
