Accident:
Crash Which Killed 2 Is Investigated
Lyman Mallary and Wife are Victims of Pike Tragedy


Investigation was continuing today into the circumstances of a car collision on the Kansas Turnpike Thursday afternoon in which two Emporians, Mr. and Mrs. Lyman D. Mallary, 514 Sunnyslope St., were killed and six other persons injured.

Under study today was the possibility of an autopsy on Mr. Mallary to determine if he had a "blackout" before the 1959 Studebaker car he was driving struck the rear of a slow-moving 1954 Buick, occupied by two soldiers on the turnpike approximately 12 miles northeast of Emporia about 3:15 p.m. Thanksgiving Day.

Under treatment at the Newman Memorial County Hospital are four passengers in the Mallary car which was bound for Topeka, where they were to spend Thanksgiving evening with friends.

Severely injured and still in a critical condition this morning, according to the attending physician, is the Mallary's son-in-law, Robert W. McCandless of Scott City, formerly of Lebo. He sustained a head injury, fractures of both legs, and internal injuries. His wife, the former Treva Mallary, 36, who suffered severe head lacerations and possible back and pelvis fractures, was reported by her physician to be in fair condition at 10:30 a. m. today. Also sustaining leg fractures and lacerations were the two McCandless children, Mark, 8, and Kim, five years old.

The two soldiers, Donald B. Frost, 26, of Topeka, the driver, and Carl L. Logan, Deer Creek, Okla., sustained minor lacerations and bruises and were treated and released from the hospital this morning.

Both of the cars were northbound. According to the Highway Patrol, the soldiers, enroute from Fort Sam Houston, Tex., to Fort Dix, N. J., reported their car was slowing down because of engine trouble, and that it was hit squarely in the rear by the Mallary car. The soldiers previously had stopped at the Emporia service area of the Turnpike for some mechanical work on the car.

The Highway Patrol added that there was no evidence of skid or braking marks of the Mallary car wheels. The investigating patrolmen also reported the Mr. McCandless and his small son were riding in the front seat with Mr. Mallary and that Mrs. Mallary, who was thrown out of the car to the pavement, was in the rear seat with her daughter, Mrs. McCandless, and granddaughter, Kim.

The accident occurred on an open and level stretch of the turnpike near milepost 98, the officers report. Both cars were said to have been damaged beyond feasible repair.

The investigating patrolmen listed Capt. Clarence L. Shivers, of the Air Corps, Omaha, Neb., as a witness to the accident. He was traveling the opposite direction, about 200 yards away at the moment of the collision.

Obituary information on Mr. and Mrs. Mallary is not available, pending the arrival of their daughter, Mrs. C. W. Koefald, from San Francisco late today. Funeral arrangements are incompleted.

Switchman 43 years

Mr. Mallary, one of the best (p. 8) known Santa Fe employes (sic) in Emporia and around the "levee" and Santa Fe Station, has been a switchman in the Emporia yards or on the division here 43 years. He once was a wrestling instructor in the Physical Education Department, Emporia State College. Best known to many Emporians and his co-railroad workers under the nickname "Pin," Mr. Mallary had been a referee for many wrestling matches. He is a former member of the Emporia Zoning Appeals Board. His daughter, Mrs. McCandless, is a former Gazette employe (sic).

Death of the Mallarys increased the automotive fatalities in Lyon County to 13 so far in 1961.

McCandless Family Is Improved Today

Improved conditions were reported today by relatives and family friends for all four members of the Robert McCandless family who were injured in a car collision on the Kansas Turnpike Thanksgiving Day. They were passengers in the car with Mrs. McCandless' parents, Mr. and Mrs. Lyman D. Mallary, 514 Sunnyslope St., who were killed. Injured were Robert W. McCandless, his wife, the former Treva Mallary, and their children, Mark 8, and Kim, 5. They recently moved from Lebo to Scott City.

Mallary Rites Monday

Double funeral services for Mr. and Mrs. Lyman D. Mallary, 514 Sunnyslope St., who were killed in an automobile accident Thursday afternoon, will be held at 4 p.m. Monday in the First Methodist Church, conducted by the Rev. Clyde S. Clark, pastor of the church. The caskets will be open until the time of the services in Roberts-Blue-Barnett Funeral Home.

Mallary Rites Today

Funeral Services were to be held this afternoon in the First Methodist Church for Mr. and Mrs. Lyman D. Mallary, 514 Sunnyslope St., who were fatally injured Thursday afternoon in an automobile accident on the Kansas Turnpike.

Lyman D. Mallary, the son of Charles and Nellie Tallman Mallary, was born Sept. 22nd, 1893, in Clinton, Iowa, and moved to Emporia in 1907. He was married to Arlene E. Loveland, June 7th, 1924, in Eskridge. He was employed as yardmaster by the Santa Fe Railroad. He was a member of the First Methodist Church and the Brotherhood of Railroad Trainmen. He is survived by two daughters, Mrs. Robert McCandless, Scott City, and Mrs. W. D. Koefoed, Redwood City, Calif.; one brother, Ben, Orinda, Calif.; one sister, Mrs. James L. Rainey, Zionsville, Ind., one granddaughter, Kim McCandless, Scott City, and three grandsons, Mark McCandless, Scott City, and Drake and Douglas Koefoed, Redwood City.

Arlene E. Loveland Mallary, the daughter of Charles and Dora E. Ferry Loveland, was born Oct. 18th, 1904, in Eskridge and moved to Emporia in 1922. She was a member of the First Methodist Church and the Harrouff Circle, Woman's Society of Christian Service, of the church; the Newman Memorial County Hospital Auxiliary, the Narcissus Garden Club, the J. F. W. Club and the Auxiliary to the Brotherhood of Railroad Trainmen. She is survived by her daughters and grandchildren and by her mother, Mrs. A. M. Allen, Kansas City, and one brothmer (sic), Glen F. Loveland, Eskridge.

The Mallary Services

Funeral services for Mr. and Mrs. Lyman D. Mallary, 514 Sunnyslope St., who were killed Thursday afternoon in an automobile accident, were held Monday afternoon in the First United Methodist Church, conducted by the Rev. Clyde S. Clark, pastor of the church. Scott Mouse was the soloist and Mrs. Robert Plummer was the organist. Pallbearers for Mrs. Mallary were Fay Hildebrand, H. E. Schlichter, Lester O. Bellfield, Ernest E. Riggs, James C. Byrd, and Roy Bassett. Pallbearers for Mr. Mallary were Clarence Chiddix, F. C. White, Herbert W. Haley, Charles Morgan, Kenneth E. Stauffer and Blaine E. Gregory. Usher were Earl E. Gadbery and Harry L. Newton. Burial was in Maplewood Cemetery.

Attending in groups were members of the Brotherhood of Railroad Trainmen and Auxiliary, of the Harrouff Circle, Women's Society of Christian Service of the First Methodist Church, the J. S. W. Club and the Newman Memorial County Hospital Auxiliary.

Mallary Death Is Blamed on Injuries

The death of Lyman D. Mallary of Emporia, who with Mrs. Mallary was killed Thanksgiving Day when their car collided with the rear of another car on the Kansas Turnpike, resulted from injuries sustained in the crash, according to W. H. Spray, Lyon County Coroner. He said an autopsy showed no coronary related ailment or heart attack prior to the crash as a contributory cause of the accident.

McCandless Family Shows Improvement At Hospital Here

Further improved conditions were reported today for all four members of the Robert McCandless family who were passengers in the car in which Mr. and Mrs. Lyman D. Mallary were killed on the turnpike a week ago.

Mark McCandless, 8, underwent an operation this morning at the Newman Memorial County Hospital for a fractured left leg and his broken right leg is in traction. His sister, Kim, 5, who sustained a right leg fracture and minor head injuries, is well on the way to recovery.

Much improved, a physician reported, is the condition of Mrs. McCandless, the former Treva Mallary of Emporia. In the crash she sustained a severe head laceration, a concussion, a cracked pelvis and a fractured hip.

Mrs. McCandless, the most severely injured person, has made marked improvement the past few days. He suffered a serious head laceration, a concussion, a fractured leg, a broken hip and sustained a heavy loss of blood before he was removed from the wreckage.

Early this fall Mr. and Mrs. Robert McCandless and family and his parents, Mr. and Mrs. N. W. McCandless, moved from Lebo to Scott City to operate a motel. His parents came here soon after they were notified of the accident.
