I Mary Whitlock wife of Wm D Whitlock of the county of Oldham State of Kentucky being sick and week but sound mind and disposing memory calling to mind the uncertainty of life and certainty of death do make and ordain this, my last will and testament in manner & form as follows:

I desire after the payment of my just debts that my executors hereinafter mentioned, shall dispose of my estate as follows:

Having heretofore given to my son in law James Downing and his wife Laura A a negro woman for which he ??? one thousand dollars, it is my will that they be charged with that amount out of the portion of my estate and that my other children hereinafter named shall each receive out of my estate that amount before the said James Downing & Loura Downing shall be entitled to any further distribution of my estate

2d Upon the division of my estate after my decease I desire that my daughters Nannie B Whitlock, Andrewella Whitlock and Loura A Downing shall each receive and take a negro slave bearing in mind, the bequest of the slave heretofore given to my son in law James Downing and wife but should my said daughters prefer it. I desire and direct that a sale be made of all my slaves and the proceeds equally divided among my said daughters.

3d I desire that the farm on which I now live in Oldham County containing about one hundred & twelve acres shall be equally divided

between my daughters herein before named should they desire a division but should they prefer to do they may sell the said farm and make equal distribution among them of the money arising from the said sale.

4 I desire that my executor out of the sale of my personal estate pay to my granddaughter Mary L Bonfils one hundred dollars

5 I direct that all my personal property after my decease be sold at public sale and the money arising from such sale to be equally divided between my daughters here before named but should they prefer to have said property divided among them without a sale they are at liberty to do so.

Finally I constitute and appoint my son in law James W Downing executor to this my last will and testatment hereby annulling and revoking all & every other heretofore made.

In witnefs I have hereunto set my hand and seal this 18th day of May A D 1862

A paper purporting to be the last will and testament of Mary Whitlock decd was produced in open court and proved to be such by the oaths of J W Clayton and John H Baldock subscribing witnefses thereto, and ordered to be recorded which is done accordingly

Note: It is not known why Mary left her daughter by George Whitlocke, Mary Pollard Whitlocke out of her will. But Mary's death certificate specifically states her parents as George Whitlocke and Mary McLaughlin.
