James Gilbert married Elizabeth Blanchett who was born abt 1763 and died abt 1820 in Halifax Co NC. Their children were Mary Gilbert Lee, Matthew Gilbert, Elizabeth Gilbert Phillips, and Nancy Gilbert Mobley.

He was drawing a Revolutionary Soldier's pension in 1840 in Henry Co GA. Lived on Lot #36 in the 11th district on Cotton Indian River. He was buried at Noah's Ark M E Church."

On this second day of January Personally appeared in open court before John T. Bentley, Henry N. Pope and Alexander Murray Judges of the Inferior Court of Henry County, now sitting, James Gilbirt a resident of Henry County and State of Georgia aged eighty-four years, who being first duly sworn according to Law, doth, on his oath, make the following declaration, in order to obtain the benefit of the Act of Congress passed June 7th 1832. That he entered the service of the United States under the following named officers, and served as herein stated. That he was drafted for a three months tour on the 1st day of June 1780. The company to which he was attached was commanded by Captain Brintley [sic, William Brinkley] in the Regiment by Colonel Jarvis [Samuel Jarvis] - and served (instead of three as he was drafted) five months and was discharged on the 1st of November 1780 - he received for this tour no written discharge as he now recollects. That he was again drafted for three months in June 1781. His Captain's name was Green and the Battalion to which he was attached was commanded by Major Griffin, that he served out his time and was discharged in September 1781. This discharge has been lost. That he resided in Halifax County, North Carolina when he was drafted and during the Revolutionary War, was in no battle, but was marched to Cross Creek, now Fayetteville, N. C. served with no Continental Troops, knew no Continental officers, has no documentary evidence, and that he knows of no person, whose testimony he can procure, who can testify to his service. That he hereby relinquishes every claim whatever to a pension or annuity except the present, and declares that his name is not on the pension roll of any State.

To the First Interrogatory He answers that he was born in Halifax County North Carolina in March 1753 --

To the Second Interrogatory He answers that he has no record of his age --

To the Third Interrogatory, he answers that he was living in Halifax County N. C. and that he has lived [in] Halifax N. C. for many years after the revolution, but is now living in Henry County Georgia.

To the fourth Interrogatory he answers that he was drafted --

To the fifth Interrogatory, he answers, that he served with or knew no Continental officers, as he now recollects and the general circumstances of his service are briefly stated in his declaration --

To the sixth Interrogatory he answers that he did receive a discharge for the last tour that he served and it was signed by Major Griffin, but that he has lost it.

I James GILBERT being in low health and not expecting to recover from my sickness, but being in sound mind and memory, wish to make some disposition of my property according to my notion among my children do therefore and hereby declare ordain and appoint this my last will and testament to that intent.

1st I resign my body to its mother earth from whence it came and commend my Soul unto God who gave it.

2nd I will and desire that all my just debts...

3rd It is my wish and desire that my property be divided equally among my children by a just distribution and that of my estate which may fall to the shares of Elizabeth GILBERT now Elizabeth PHILIPS shall be equally divided between them (To wit her and her two children and their portion which will go to the two children by PHILIPS now alive by the name of Elizabeth Ann and Delila Wellman PHILIPS shall make to their benefit in infancy and when they or either of them shall become of lawful age or marry they shall have their part of my estate that may fall to them according to the above division and intent.

4th It is also my desire and wish that my old servant Nelly be not included in the disposition of my estate among my children but that she remain in the family with the child of my choice.

5th It is also my desire and wish that my children choose a man apiece (if they agree on the notion) to divide my property among them equally.

6th It is also my desire and wish that Mathew GILBERT and John MOBLEY be Executors to carry this my will into effect.

7th It is furthermore my desire & wish in relation to the interest in the land bought of William G HIARETEN (?) known as 29 in the 11th of Henry by myself and son Mathew GILBERT that Mathew have his choice to pay for the land and keep it or let it fall into my estate and be divided among my children.

In testimony whereof I have herunto set my hand and affixed my seal this the 29th of August in the year of our Lord 1840. James (X) GILBERT. Witnesses: Elisha JOHNSON, William G HINTON, John MOBLEY, William L TUGGLE.

Wit; Levi N PHILLIPS, N C ADAMSON JP. Recorded 23 Jan 1851.
