Evelyn petitioned the Court on July 30, 1858. She said Dennis "departed this life on the 18th day of June, 1858". Jarred Howard testified in court that he saw Dennis N Finn sign, seal, publish and declare the Will. George W Powell and Lydia Rawdon were witness. (Note: there was no mention of a son named James). William J Breedlove consented to act as guardian for minor children by 1860.
