A Statutory Warranty Deed, dated Feb 12, 1946 and filed Nov 3, 1948, between Nicholas Neises and Kathrina Neises, his wife, and other persons, conveyed and deeded to C H Winkelmann as Bishop of Wichita, the following tract:
"Commencing at the Northwest corner of the Southwest Quarter of Section 3, Township 31 South, Range 3 West of the 6th Principal Meridian, thence East 20 rods, thence South 16 rods, thence West 20 rods, thence North 16 rods to place of beginning in Sumner county, Kansas. "This deed constitutes a gift of the above described property for use as a cemetery, and no money consideration passed."
A Deed dated Oct 27, 1948 and filed April 14, 1949, shows Mark K Carroll as Bishop of Wichita, and by William M Farrell and Joseph C Goracy, as Trustees under the Last Will and Testament of Christian Winkelmann, deceased, all three being grantors, deeding to the Catholic Diocese of Wichita, a non-profit corporation, grantee, the same above described tract.
In this Deed the grantors conveyed to the grantee "all of their title to, or interest in, any real estate whatsoever located in Sumner County, Kansas."
The first burial was that of Clarence Timmermeyer, who died March 11, 1950.
