The son of Dr. J. Thomas Acton and Alice T. Allen, Herbert registered for the draft on September 12, 1918. At the time, he was a traveling salesman for the Greenpoint Metallic Bed Company. His territory covered the entire south.

Herbert's father was the first dentist in Anniston, Alabama. He died in July of 1916. His mother died some time after 1920. In the 1920 census, she was living in Citrus County, Florida. Herbert had 2 brothers.
