Annie Shirley was born in 1865 to
Tahlequah District-Judge L.W.Shirley and Annie Laurie Foreman Shirley.
At 16 she married Timothy Brown Hitchcock, the Tahlequah school teacher.
After an affair with Jim Craig, a charge of adultery had been filed against him in the federal court in Ft. Smith Arkansas. He was arrested and latter escaped in route to Ft. Smith.
Deputy U.S. Marshals Thomas Whitehead and Joshua Poorboy went after him. They were staying at the home of Judge Shirley when Annie asked John Brown,Waco Hampton and John Roach to kill the two Marshals. About 10pm on Dec. 8 1891 Brown called the Deputies out of the house.And from the gate in front of the Judges home, the two Marshals were killed.
John Roach who was wounded in the shootout would later testify against Brown at his trial.
Waco Hampton ,a known killer and fugitive from the age of 14,was later shot and killed along with his horse by Deputy U.S. Marshal C.A.Bruner.
John Brown was sentenced to hang by Judge Issac Parker in Ft.Smith. The sentence was overturned twice on appeal.On Dec 24 1896 he pleaded guilty to manslaughter and was sentenced to one year in the Columbus Ohio Prison.
Thomas Whitehead was the Grandson of LeRoy M Davis and Sophronia Starr,Cherokee born About 1830
Joshua Poorboy was also of Cherokee descent.
Annie was later married to Craig and then Marion Jackson Lane. and she died in 1930 at Tahlequah Oklahoma. Under the name of Annie Lane .
