Clara J. Dietrich, Plaintiff.

vs.

Leon Dietrich. Defendant.

************************

Plaintiff states that on the 22nd day of February, 1888, at the county of Nodaway and state of Missouri, she was lawfully married to the defendant; that she continued to live with the defendant as his wife from and after said date until the 22nd day of December, 1905; that during all that time the plaintiff faithfullyl demeaned herself, performed all her duties as the wife of the plaintiff and at all times treated him with kindness and affection; but said defendant, wholly disregarding his duties as the husband of the plaintiff has been guilty of such cruel and barbarous treatment as to endanger the life of the plaintiff, and has offered such indignities to plaintiff as to render her condition in life intolerable, in this:

Plaintiff avers that the defendant is of a quarrelsome and abusive disposition, and has upon divers occasions cursed and swore at plaintiff and has called her such vile and indecent names as to be unfit to be spread upon the records of the court; that the defendant has upon frequent occasions threated violence toward the plaintiff and on the day of December, 1905, struck plaintiff with his fist, knocking her down and kicking her until the plaintiff was compelled to and did call the officers of the law for protection and assistance. Plaintiff further states that there was born of said marriage, Charles, Roy, Clarence, Earl, Maggie, Earnest, and Laura Dietrich, all children of tender years; that said children are now living with the plaintiff and being supported wholly by her. Plaintiff further states that she is a resident of Nodaway county, Missoui, and that she has resided in said state for one whole year next before the filing of the petition. Wherefore the plaintiff prays to be divorced from the bonds of matrimony contracted as aforesaid with the defendant, and that she may be awarded the care and custody of her minor children aforesaid, and for such other and further orders, decrees and relief in the premises to which she may be entitled, and for all other further and proper relief.
