According to Confederate Roster reports for the Tennessee 33rd Infrantry Company H, Capt. McWherter was killed in action on Sept 19. 1863 in the Battle of Chickamauga. Under the Direction of Gen. Otho Strahl, the recorded action of the regiment on Sept 19th took place on Brock Field beside Brotherton Rd. It is almost without question that Capt. McWherter was killed at this location. He is buried and his gravesite is at Marietta Confederate Cemetery.

Capt. McWherter was inlisted for service at Union City on Oct. 18, 1861. He was involved in the Battles of Shiloh (April 6-7, 1862), Cornith Campaign (April-June 1862), Perryville (Oct. 8, 1862) Murfreesboro (Dec. 31 - Jan. 3, 1863), and the Tullahoma Campaign (June 1863) before his death at Chickamauga on Sept. 19, 1863.

In a book entitled "Tennessee Civil War Veterans Questionaires" Confederate Veteran George Ross mentions Capt. Bill McWherter along with several of the Captain's relatives that served in Company H. They are Almus McWherter (Brother), F.l. Mcwherter and Robert McWherter. Also 2nd Lt. J.M. McWherter is listed as having reinlisted on 4/25/62.
