From the Minutes of the Burningtown Baptist Church:

"NORTH CAROLINA MACON COUNTY, June 15, 1839

On the day and date above written, we, the following United Baptist preachers, met at the Meeting House on Burningtown creek, as presbytery according to the request of a number of members of our order for the purpose of examining their strength in order to become a constitution, which we have done carefully. Therefore, believing that we have found them possessed with strength and ability, we have constituted them a Church of Christ, by the name of Burningtown Baptist Church. And also have ordained bretherns, Jacob Shope and Thomas Welch, to be deacons. 2nd the church proceeded to appoint Bro. Welch their Church Clerk and Treasurer. 3rd chose Bro. Caler to supply them for the present, 4th opened the door and received Disey Lou Allen by experience.

Apparently Deacons Thomas Welch and Jacob Shope were to acquire property in the name of the church. They accomplished their mission for the Burningtown Baptist Church was alive and flourishing.

"The Last Will and Testament of Jacob Shope

In the name of God, Amen.
I, Jacob Shope, being of sound mind and memory, but knowing that it is appointed once and for all to die, do therefore make publish and declare this my Last Will and Testament: First of all I will my soul to God who gave it; Second my body to the dust from whence it came; Third a decent burial to my body to be paid for out of my estate; Fourth to my loving wife Isabella Shope I bequeath all my landed estate in Macon and Cherokee Counties, also all my personal property of every kind and description in the house and kitchen, and on the farm; also all the perishable property in horses, cattle, hogs and sheep; Fifth I appoint my dear Wife Isabella Shope as Exectrix of my will; Sixth if my wife Isabella Shope make a will and in it will landed property to A.A. Justice's heirs and John Shope's heirs, viz. John B F Shope deceased it must be specified to them and the heirs of their body otherwise it shall not be legal; further if the heirs of my daughter A.A. Justice's wife die, or any of them die, then the property, landed or personal shall descend to their surviving brother and sister, and if the brother, then to two surviving sisters, or if but one be alive then to that one; and if all three die then to the heirs of the body of my granddaughter Anthra Anderson; and if my wife landed property to John B F Shope's heirs, and if one of them die then his estate shall descend to his other brother and the surviving heirs of the body of my daughter Lucinda Justice equally. Ninth the home place or my residence and fifty acres up the branch we live on I desire Mary Elizabeth Justice and the heirs of her body get. Tenth, the Cherokee land lying on the Nottely River after Eldridge Burnett Shope and John Baxter Shope shall have paid Anthra Isabella and J D W Justice three hundred dollars, that is one hundred and fifty each then they shall have and possess that land. Eleventh, No public sale of any species or kind of property after my death shall be legal or valid; for it must be understood that all the perishable property and the household and kitchen furniture shall belong to the heirs of my daughter, Margaret Lucinda Justice, this the 8th of Dec. Jacob Shope

Jacob Shope died Sept. 5, 1876. It seems most certain that he died in his home on Burningtown Creek and was buried in the Burningtown Baptist Cemetery where there are numerous unmarked graves. There are 114 graves marked with stones or cement markers, but there are no names etched on them. He was a member of the Burningtown Baptist Church and probably had his children, Francis, John B. F., Jacob Jr., and Margaret Lucinda Shope Justice buried there.
