15 January 1909 FATAL RESULT OF QUARREL BETWEEN TWO BOYS
John Bushway, Jr, Shot and Killed by Ralph Morey
The community was horrified on Saturday by shocking tragedy in West Brainerd, in which John Bushway; the 10 years old son of John bushway was shot and instantly killed by Ralph Morey, age ten, son of Eugene Morey, a neighbor. The only witnesses of the shooting were Frank Bushway, the 8 year old brother of the victim, and Eddie Crowley, eight years of age, a son of Jerry Crowley, the well known saloon man.
It appears from the evidence heat at the inquest that the Bushway boys were piling up brush on Saturday afternoon for an uncle, Victor Bushway, across the street from the Morey house. They had quarreld with the Morey boy in the morning, and in the afternoon the quarrel was renewed.
At this time young Crowley was with the Bushway boys. Morey called him over to where he was standing across the street, saying the he wanted to tell him something. The two then went into the Morey house and soon came with with a rifle which Crowley held and helped Morey load. Morey called out to John Buyshway, "I'll fix you" and being unable to lift the gun to his shoulder, held it at his hip and shot at Bushway. The bullet entered the right side of the boy's neck severed the jugular vein and passed out between the shoulders, completely shattering the spinal column. Death was instantaneous.
Young Crowley declares that the Morey boy took a stick and threatened him and compelled him to climb up over a chair and get the rifle; that after the gun was loaded he turned to go home and Ralph shot. He turned around at the sound and Ralph was holding the gun at this side. Crowley went over to where John lay and told Morey he had shot him. Morey came to the fence and looked at John but did not come into the road. After the shooting he said to Ralph, :You have shot him," and Ralph replied "I told him to get out of the way." Young Crowley, however, had not heard Ralph say that before the shooting.
Mrs. Eugene Morey, the mother of the young murderer, was calling at a neighbor's at the tome of the tragedy and there was no one at home but Ralph.
Coroner Gibson was at once notified and took charge of the remains, which were taken to Clark's undertaking. A coroner's jury was impaneled on Monday morning, consisting of Wm. Rosenkraur, A. E. Whitney, C. A. Pierre, Adam Brown, A. A. Graham and John C. Heard. After hearing the testimony, the following verdict was rndered.
We find that the said John Bushway came to his death by a shot from an automatic Winchester rifle, in the hands of Ralph Morey of Brainerd, Minn.
Ralph Morey was arrested late Saturday afternoon and taken to the county jail. He was arraigned in the municipal court on Monday, for a hearing on the charge of killing Bushway, but the state was not ready to take up the case and the examination continued until Wednesday morning at 10 o'clock. Ralph took his arrest very cooly and seemed unconcerned over the tragedy, though badly frightened when first seen by Coroner Gibson. He says ver little about the shooting. The boy has a rather hard name in his neighborhood, and by those who knew him well is generally considered a degenerate.
When the case was called in the municipal court on Wednesday morning it was announced that by agreement of County Attorney Warner and Attorney M. E. Ryan, who had been retained for the defense, there would be no preliminary hearing, as they had declared that the entire matter should be left in the hands of Judge Mel McClenahan of the district court. The boy was thereupon commited to the custody of the sheriff until Judge McClenahan is able to take up the case and decide as to what disposition shall be made of him.
