Elmo Cox and Roy Garfield were hit on 71 Highway by a drunken driver who did not stop at the time of the accident. It was later noted by a local newspaper that Charles Gifford reported finding the bodies to local authorities.

Mr. Gifford had been seen washing off the front of his vehicle after the accident at the home he resided in with his wife, Lois and her mother, Rosalie Springer Tracy. Mr. Gifford's wife Lois was Elmo's Aunt and his mother-in-law, Rosalie was Elmo's grandmother. It is noted that Elmo's great-grandfather, Dennis Springer was the sheriff of Barton Co., MO.

Elmo died immediately from a skull fracture and his friend, Roy died a few hours later. Charles Gifford attempted to attend Elmo's funeral at the home of his parents who resided at 720 E. Ashland, Nevada, MO, however, he was immediately escorted from the home by Elmo's father, Raymond E. Cox and told to never return to their home.
