There are other Heath headstones missing from the same era--one oral history said that some were 'washed away in a flood.'

There used to be a Heath Cemetery in T52N R35W S35. Both James Heath and brother in law William 'Burke' McComas were "original owners" having adjacent pieces. The original owner in S35 (40a) was James Heath a warrantee/patentee dated 11/1/1848. adjoining this property, also in S35 (80a) is William Burke McComas a warrantee/patentee dated 5/1/1846.

William Burke McComas and wife Nancy Heath sold their land to brother in law James Heath on 24 Aug 1847 for $200. At the time of his death, James Heath owned the following property:

90 acres of land the SW qr. of Sect 35 T 52, Range 35
76 acres in south half of SE qr. Sect 34 T 52, Range 35
40 acres in Sect 34 SE qr. T52, Range 35

James Heath was the son of Israel Heath and his wife Elizabeth (Blue) Heath. Eldest of 9 children, he was born 1800 in Berkeley Co VA (now WV). His family moved to Cabell Co VA (now WV) about 1809 and there James Heath met Chloe McComas, the daughter of Moses McComas and Lucy (Napier) McComas. James married 29 Dec 1829 in Cabell Co WV, Chloe McComas born 1808 died 1864.

A very unique situation occurred in Cabell Co West VA. Five of the children of Israel Heath married five of the children of his neighbor Moses McComas. This was one of those five marriages. In 1839 the entire extended clan which by then included many combined grandchildren, moved into early MO when land became available. James and Chloe Heath lived in Platte Co MO. James left no will, but his estate was settled in Platte co MO. At the time of his death he owned 196 acres in Range 35, Twp 52, Sections 34 and 35. His sister Nancy (Heath) McComas and her husband William Burke McComas owned the adjacent 196 acres Range 35, Twp 52. On 5 Mar 1860 James sold a small portion of his land (4 and 5/100 acres) to Charles L. and Rebecca McComas. Rebecca was the widow of Hiram McComas and they were not in a good way after the death of Hiram McComas. Rebecca was Chloe (McComas) Heath's sister. Charles L. McComas was a son of Rebecca. Sons Clinton Heath and Israel Love Heath were appointed administrators for his estate when James Heath died. On a document dated March 1864 Clinton and Israel Love Heath stated that the only heirs left at the time of death of James Heath were: Lucy E. Malotte, Clinton Heath, Israel L. Heath, Sarah A. Babcock, Mary C. Heath, Aletha A. Heath, Charles H. Laughlin. In order to serve as administrators of the estate of their father James, they had to present a bond in the amount of $5,000 with A.G. Brown and William Moore as securities.

Reviewing the inventory of his estate at time of death, James Heath was a wealthy man owning land, cows, sheep, horses, hogs, oxen, wagons, wall clock, much equipment, and books. He must have been a reader.
