Richard enlisted in the Confederate States Army on 21 October 1861 in Abingdon, Virginia. He was mustered as 4th Sergeant in Company D of 9th Kentucky Mounted Infantry. He was promoted to 2nd Lieutenant on 1 June 1864. On 1 September 1864, Richard was captured near Jonesboro, Georgia. For some reason he was exchanged per orders of Gen. Sherman on 19 & 22 September 1864. He surrendered at Washington, Georgia on 6 May 1865 and took the Oath of Allegiance on 17 May 1865. The following info was noted at the time he took oath: residence - Harrison County, Kentucky; complexion - dark; hair - dark; eyes - hazel; height - 5 ft. 11 inches.
