The Grand Jury found a true bill against Smith, for "wilfull murder," for the killing of Shoemaker.

SATURDAY, 14 JUNE 1862

A MURDER in MARIPOSA -- The 'Gazette' gives an account of the homicide of a man named Nathan Shoemaker, by one Smith, on the 30th of May, at Clark's steam mill, in the county of Mariposa. For some words that passed between the 2 about a mere trifle, Smith returned after the lapse of an hour or 2 to where Shoemaker was at work, armed with a bowie knife and swore to kill him. He commenced the attack by the use of such epithets as tempted Mr. Shoemaker to strike at him with a plank, when Smith plunged the knife he held secreted in his hand, into Shoemaker's abdomen. The wounded man then turned, fled and was pursued and cut in several other places. He died from the effects of his wounds a few days after. Smith was arrested and is now in jail. Deceased was an amiable, excellent man, highly respected and in his unfortunate death is much lamented.
