Benjamin Vail removed with his father from Long Island to Goshen, NY. Later settled (now Mt Hope) where he was a farmer and justice of the peace. When the news of the invasion of this region by Indians and Tories under Brandt reached Goshen, Benjamin Vail commanded a company in the militia regiment of Col Tustin, Jr., who was a physician at Goshen. He marched with the regiment and took part in the battle. The conflict was brief, since the militia were caught in a skillfully planned ambush formed by Brandt and most of the men engaged on the colonial side were slaughtered. Brandt withdrew his own forces substantially unharmed. Col. Tustin, Capt. Vail and nine other officers were slain. The widow of Capt Benjamin Vail became a pensioner for the services of her husband.

Capt Vail was wounded in the battle and afterwards was found seated on a rock and bleeding profusely. He was killed by a Tory in this situation.
