Elias served in the Confederate Army as a private. He inlisted in Company C, 17th Arkansas Infantry, November of 1861 and was promoted to Sergeant, later demoted back to Private, when his regiment becaome the 21st. He was detailed at times as a waggoner. He was captured at the siege of Vicksburg (Vicksburg capitulated on 4 July 1863) and was released after he signed the oath that he would not take up arms again against the United States. After he returned home, he joined the Union Army in January of 1864 - I suspect desperate for a paycheck. He enlisted in the 2nd Regiment, Arkansas Infantry, US Army, again as a private. Records reveal he was a cook. He was absent without the leave about the time his home was burned by guerillas and I suspect he returned to provide for his family. He was mustered out of the Army 28 Feb 1865.
By 1869, Elias had moved his family to Crawford County, Arkansas, Cedar Creek Township.
His death was recorded in "The Van Buren Press", 15 November 1879: DIED HAYES. Near Figure Five on the 5th inst. Mr. Ely Hayes, age 53 years. (instant - this month)
The grave marker that is now in Sarah Grove's Cemetery was placed by family in the 1990's to replace two old and broken stones. The older stones did not have Martha's maiden name, nor the children's names. The inscription on Elias's old stone read, "Death with his cold icy fingers has taken the dearest companion from our house". The old stone had an error - he had his death as 5 Oct 1879, but the newspaper article makes plain he died in November.
