Son of Abigail Burnham and Nathaniel Phelps III.

An attorney, who had practiced in Massachusetts and New York.

Married (1) Dorothy King Root, 24 April 1740 at Hadley, Hampshire County, Massachusetts. They had three sons, who lived to adulthood, Solomon, Charles Jr. (Deacon Charles Phelps, who married Elizabeth Porter), and Timothy (who married Zipporah Williams).

Two sons, Joseph and John died as children; a daughter, Lucy, died young and three girls lived to maturity: Dorothy (married Samuel Warner), Abigail (married John Williams) and Experience (married 1. Caleb Cooley & 2. Aaron Dickinson).

Charles and family removed to the territory during the 1760's and on the third attempt to charter the settlement of the township of Marlboro, Phelps and his associates were successful.

Charles, as the principal grantee, was directed to call town meetings in accordance with the granted Charter. The town was laid out in May 1762.

Among the first settlers, he and his family took up a farm in April 1764. They were confirmed Torys; and, although bearing a prominent part in the history of the town, Charles was persecuted on account of his devotion and allegiance to New York, his former state.

He was fined, imprisoned, lost property and suffered banishment because of his defiance of local government policies.

He married (2) Esther Kneeland (widow of Timothy Kneeland), 2 November 1778, after his first wife's death. They had a daughter, named Lucy (Luce, on her stone) Phelps (for his and Dorothy's deceased daughter) on 24 January 1780. Lucy II lived until 29 August 1786.

Considered eccentric by town folks, his family was unhappy and his son, Solomon, died tragically the year after Charles passed away.

Later, Charles' widow (Kneeland) married a third husband, Israel Smith. She died 22 September 1813.
