Tom was the son of Andrew Fitzpatrick and Rachel Jones Ferguson and grew up in Iron Duff of Haywood County, NC. He married Sarah McCracken, daughter of David Vaughn and Annie Jones McCracken of nearby Crabtree on January 26, 1858. He served as an officer in the CSA, then settled down to farm in Haywood County. His father owned some property in the Leicester area, and about 1869, he and his family spent a whole summer cutting their way across Sandy Mush Bald to the settle as the second family in the area. Later Sarah was afflicted with rheumatic fever, and for 30 years was unable to cook or do housework. They kept 3 or 4 young girls hired to help out and to help care for Andy and his wife who were quite old.Their farmhouse is still occupied in the Sandymush Community in 2009.

Thomas and Sarah were the parents of David Piletus who married Frances "Fannie" Noland; Sarah Ann who married A. B. Wells; Champ Seymour who married Minnie (King) Pendleton; Rachel Eleanor who married (1)Jesse Manon Noland and (2) Horace Carlisle McCracken; and Dora Lee who married Thomas R. Rogers. She and Thomas are buried in this cemetery. Her memorial is # 42134112.
