PUBLIC NOTICE April 1880


The People of the State of New York, by the grace of God free and independent: To ISAAC CHARLOCK, MARIA CHARLOCK and MARTHA STOUT, all residing in the city of New York: ROBERT TOMPKINS and DANIEL TOMPKINS, both residing in Dresden, Yates county, New York: JAMES W TOMPKINS and ELIZABETH PHILLIPS nee Tompkins, both residing in East Fishkill, Dutchess county, N.Y. : SUSAN ANN SMALLEY nee Tompkins, residing at Pratteburg, Steuben county N.Y.: MARY REED nee Tompkins, residing at Danbury, State of Connecticut: JAMES E DEAN, SARAH M DRESSSER nee Dean, EMMA RUSSELL nee Dean, MARY RUSSELL nee Dean, REUBEN KNAPP and CLARK KNAPP, all residing at Warren, Lee County, State of Iowa: NEWTON KNAPP, residing at Primrose, in said county of Lee; JAMES KNAPP, residing at Allerton, Wayne county, state of Iowa and the heirs in-law and next of kin of LAVINA CUSHMAN nee Knapp and BETSEY RUNDELL nee Knapp, deceased, sisters of REUBEN D KNAPP, deceased, whose names and place of residence are unknown and cannot after diligent (search be found) send greetings; Whereas GEORGE H KNAPP (son of brother Benjamin Knapp) of the town of Phillipstown in the County of Putnam, has lately applied to our Surrogate of the county of Putnam to have certain instrument in writing relating to both real and person estate duly proved as the last will and testament of REUBEN D KNAPP, late of the town of Phillipstown, in the county of Putnam, deceased, therefore,

You and each of you are cited to appear before our Surrogate at the late residence of said Reuben D Knapp, deceased, in the town of Phillipstown, Putnam county, New York, on the 18th day of June, 1880, at 10 o'clock in the forenoon of that day, then and there to attend to the probate of the said last will and testament. 

In testimony whereof, The Surrogate of our said County has hereunto affixed the Seal of the L.S. Surrogate's Court of the said County of Putnam, this 29th day of April, 1880.

LAST WILL AND TESTIMONY


Be it remembered, that hertofore, to wit, on the twenty ninth day of April, in the year one thousand eight hundred and eighty, GEORGE H KNAPP the sole executor, named in the Last Will and Testament of REUBEN D KNAPP, late of the town of Philipstown in the County of Putnam, deceased, appeared in open court before the surrogate of the county of Putnam and made application to have the said last ill and testament which relates to both real and personal estate, proved and in such application the surrogate did ascertain by satisfactory evidence, who were the heirs and next of kin of the said testater, and their respective residences, and said surrogate did therefore issue a citation in due form of law, directed to the said heirs and next of kin by their respective names stating their respective places of residence, requiring them to appear before said surrogate, at the late residence of said REUBEN D KNAPP in the town of Phillipstown, county of Putnam on the eighteenth day of June, then next to attend the probate of the said will. And afterwards, to wit on the said eighteenth day of June satisfactory evidence by affidavit was provided and presented to said surrogate of the service of the said citation, in the mode prescribed by law, and on that day noe one appearing to oppose the probate of such will such proceedings were thereafter had afterwards that the surrogate took the proof of said will hereafter set forth on this eighteenth day of June in the year one thousand eight hundred and eighty and he adjudged the said will to be valid will of real and personal estate, and the proofs therefor to be sufficient, which said last will and testament and proofs are as follows, that is to say:

this is the last will and testament of REUBEN D KNAPP of Phillipstown Putnam County New York. 

I devise and bequeath all the real and personal estate to which I shall be entitled at the time of my decease unto my nephew George H Knapp, son of my deceased brother BENJAMIN KNAPP absolutely excepting the sum of six hundred dollars, which I direct my executor, heretoafter named to divide unto three equal parts of two hundred dollars each and to pay two hundred dollars to each of the following named persons, ISAAC CHARLOCK, MARIA CHARLOCK and MARY REED my nephew and nieces as soon after my decease as may be, and I further direct that all my just debts be paid by my executor, hereinafter named out of the estate bequeathed to said GEORGE H KNAPP and I appoint GEORGE H KNAPP above mentioned sole executor of this my last will and testament, in witness thereof and have hereunto set my hand this twenty first day of April in the year of our Lord eighteen-hunderd and seventy four.
