John leaves a will in York County (Book M, page 358) which was written 16 Nov 1810, and which he signs as "John Small". In it he leaves his entire estate, real and personal, to his wife "Philabina" so long as she remains his widow. After a few directions, he names his six children, who are to receive equal shares of his estate after his wife's death: Joseph Small, Catharine intermarried with Jacob Graferrs/Grafeare(?), Elizabeth Small, Anna Maria Small, Enos Small, and William Small. He then names his executors as his wife (not named here), his son Joseph Small, and his brother Jacob Small of York township. Witnesses: Tobias Meyer, Peter Small, and Ignatius Leitner. Proved 21 Dec 1811.
In 1812, an advert is placed in the Pennsylvania Republican, 14 March edition, page 3; to sell a half lot of ground, "being the fourth half lot west of the Court House on the north side of Market St in the Borough of York, with a two-story brick house, a two-story back building, a log barn, and a well at the kitchen door, at (as?) the late dwelling house of John Small, deceased..."
In the Orphan's Court, 17 Dec 1816 (Book M, page 81), a petition is filed by Anna Mary Small, Enos Small, and William Small, the minor children of John Small, all above the age of 14, for which the Court appoints "Philipina" to be their guardian.
