Charles Eyser served as marshall of Fort Morgan for four years and was a life-long resident.

Following a tip on bootlegging occurring in the "dry town," Marshall Eyser went to the upper livings quarters of the Godfried Weimer's Manhattan Cafe on Main Street.

Confronting one of the bootleggers, gunfire ensued. Eyser was killed and the bootlegger, John Swan was wounded.

During the shoot-out, Mrs. Godfried Weimer was hit by a bullet and died instantly.

All three bootleggers were arrested. John Swan was convicted of both murders; however, he managed to saw through the bars of the jail, escaped and was never heard from again.
